2 great fun bags,

There is no contract until the two great fun bags' written quotation is accepted in writing and moneys paid as agreed. Variations will not form part of the contract unless signed by both parties, subject to conditions below.

the booking is not confirmed until the deposit is paid full and clear;
to pay the moneys agreed in writing and at the times specified;
late payments will attract book-keeping fees of $25 per reminder, and the two great fun bags reserve the right to cancel bookings where breach of contract occurs;
where a booking is cancelled by the client with 60 full days notice, fee deposit will be refunded in full less
- $25 book keeping fee plus
- any expenses paid in advance by the fun bags as a result of the booking;
where a booking is cancelled by the client with less than 60 or more than 30 days notice, deposit will be refunded less
- fifty percent of fee deposit plus
- any expenses paid in advance by the fun bags as a result of the booking
where a booking is cancelled by the client with only 30 days or more than 14 notice, the fee deposit is forfeit;
where a booking is cancelled by the client with only 14 days or less notice, the total amount shown on the agreement (i.e. the quotation/acceptance form) will become due and payable on the agreed date.
where a booking is cancelled by the fun bags, the funbags will repay any deposit or agreed travel and accommodation expenses paid to or on behalf of the funbags by the client
the funbags do not agree to indemnify any client against any losses incurred as a result of any booking or cancellation whatsoever outside the terms and conditions stated here
the client manages its own public liability risk and indemnifies the funbags against any claim from the client or the clients guests agents or employees arising out of any performance or performance agreement
the two great fun bags' quotation will specify any merchandising rights or arrangements which are a condition of hire
the client, the client's guests, agents or employees, may take still photographs but are asked not to otherwise record the performance unless recording is agreed in writing to be an intention of the contract
the client accepts that any receiving or sending of text messages or taking phone calls during a performance or presentation will reduce the fun or effectiveness of the performance or presentation
the client agrees that the performance or presentation can be affected by the layout of the venue or other activities occurring e.g. the noise from a kitchen serving other venue clients
